The PERM process generally includes the following steps:

Register the Prevailing Wage Determination (PWD) Request – The employer must obtain a Prevailing Wage Determination (PWD) from the U.S. Department of Labor (DOL). This establishes the minimum required wage for the position based on the job's location and occupation.

Labor Recruitment Process – The employer must prove the U.S. labor market by posting job advertisements.

Submission of Form ETA 9089 – The employer submits the PERM application to the U.S. Department of Labor (DOL).

Next Steps – If approved, the employer can proceed with filing the I-140 Immigrant Petition with USCIS.

DOL Decision – The U.S. Department of Labor (DOL) reviews the application and approves, denies, or audits the case.
