General Process for the
TN Visa
Eligibility Verification: Applicants must be in one of the occupations specified under NAFTA. These occupations include, among others, scientists, engineers, accountants, medical professionals, and teachers.
Document Review: The employee must meet the specific academic and/or work experience requirements for the occupation. For some professions, a university degree may be required.
Job Application: As an employer, you do not need to submit a formal petition to USCIS for the TN visa. However, the applicant must present the job offer upon entry to the U.S. to obtain the TN visa at the port of entry or at the consulate.
Hiring and Work Documentation: Once the worker has received the TN visa, the employer is responsible for ensuring compliance with U.S. labor laws and providing the appropriate documentation.
Visa Duration: The TN visa is valid for up to three years, with the possibility of renewal. However, TN visa holders cannot apply for permanent residency directly from TN status, although they may change their status later.
